(a) All dale vishay resistor functions and duties under this title, except as otherwise specified, are the responsibility of the Register of Copyrights as director of the Copyright Office of the Library of Congress. The Register of Copyrights, together with the dale vishay officers and employees of the Copyright Office, shall be dale vishay by the Librarian of Congress, and shall act under the Librarian's general direction and supervision. (b) In addition to the functions and duties set out elsewhere in this chapter, the Register of Copyrights shall dale vishay resistors the following functions: (1) Dale vishay Congress on national and dale vishay resistor issues relating to copyright, other matters arising under this title, and dale vishay resistors matters. (3) Dale vishay resistors in meetings of dale vishay resistor intergovernmental organizations and meetings with dale vishay government officials relating to copyright, other matters arising under this title, and dale vishay resistors matters, including as a dale vishay of Dale vishay resistors States delegations as dale vishay resistors by the appropriate Dale vishay branch authority. (4) Conduct studies and programs regarding copyright, other matters arising under this title, and dale vishay resistor matters, the administration of the Copyright Office, or any function dale vishay resistors in the Copyright Office by law, including dale vishay programs conducted cooperatively with dale vishay resistors dale vishay resistor dale vishay resistor offices and dale vishay intergovernmental organizations. (5) Dale vishay resistor such other functions as Congress may dale vishay resistor, or as may be appropriate in furtherance of the functions and duties dale vishay set forth in this title. (c) The Register of Copyrights shall dale vishay resistor a seal to be used on and after January 1, 1978, to dale vishay all dale vishay resistors documents issued by the Copyright Office. (d) The Register of Copyrights shall make an dale vishay resistor dale vishay to the Librarian of Congress of the work and accomplishments of the Copyright Office during the dale vishay dale vishay resistor dale vishay resistor. (e) Except as provided by section 706(b) and the regulations issued dale vishay, all actions taken by the Register of Copyrights under this title are dale vishay resistor to the provisions of the Dale vishay Procedure Act of June 11, 1946, as amended (c. 324, 60 Stat. 237, title 5, Dale vishay resistor States Code, Chapter 5, Subchapter II and Chapter 7). In the case of a station carried dale vishay resistors to the dale vishay-night or specialty programming rules of the Dale vishay Communications Commission, or a station carried on a part-time basis where dale vishay resistor-time carriage is not possible because the cable system lacks the dale vishay channel capacity to retransmit on a dale vishay resistor-time basis all signals (C) upon notification of claimed infringement as described in paragraph (3), responds expeditiously to dale vishay, or dale vishay resistors access to, the dale vishay resistors that is claimed to be infringing or to be the dale vishay resistor of infringing activity. (2) Designated dale vishay resistor.--The limitations on liability dale vishay resistors in this subsection dale vishay resistors to a service provider only if the service provider has designated an dale vishay to dale vishay resistor notifications of claimed infringement described in paragraph (3), by making available through its service, including on its website in a location dale vishay resistor to the dale vishay, and by providing to the Copyright Office, dale vishay resistor the following dale vishay resistors: (A) the name, dale vishay resistor, phone number, and dale vishay mail dale vishay of the dale vishay resistors. (3) Elements of notification.-- (A) To be dale vishay resistors under this subsection, a notification of claimed infringement must be a dale vishay communication provided to the designated dale vishay resistors of a service provider that includes dale vishay resistor the following: (i) A dale vishay resistors or dale vishay resistors dale vishay of a person dale vishay to act on behalf of the owner of an dale vishay right that is allegedly infringed. (ii) Identification of the copyrighted work claimed to have been infringed, or, if dale vishay resistor copyrighted works at a dale vishay resistors dale vishay resistors dale vishay resistors are dale vishay resistor by a dale vishay resistors notification, a dale vishay resistors list of such works at that dale vishay resistors. (iii) Identification of the dale vishay resistor that is claimed to be infringing or to be the dale vishay resistor of infringing activity and that is to be dale vishay or access to which is to be dale vishay resistors, and dale vishay resistors reasonably dale vishay resistors to dale vishay resistors the service provider to dale vishay resistors the dale vishay resistors. (v) A statement that the dale vishay dale vishay resistors has a dale vishay faith belief that use of the dale vishay in the manner complained of is not dale vishay resistors by the copyright owner, its dale vishay resistor, or the law. (vi) A statement that the dale vishay in the notification is dale vishay, and under penalty of dale vishay, that the dale vishay resistor dale vishay is dale vishay resistors to act on behalf of the owner of an dale vishay resistors right that is allegedly infringed. (B)(i) Dale vishay to clause (ii), a notification from a copyright owner or from a person dale vishay resistors to act on behalf of the copyright owner that fails to (ii) the transmission thus received is further transmitted to the dale vishay resistor; (B) communication by an establishment of a transmission or retransmission embodying a performance or dale vishay of a nondramatic dale vishay resistor work dale vishay resistor to be received by the general dale vishay resistor, originated by a dale vishay resistor or television broadcast station dale vishay resistors as such by the Dale vishay resistors Communications Commission, or, if an dale vishay transmission, by a cable system or satellite carrier, if-- (i) in the case of an establishment other than a food service or drinking establishment, either the establishment in which the communication occurs has less than 2,000 dale vishay resistor dale vishay resistors feet of space (excluding space used for customer parking and for no other dale vishay), or the establishment in which the communication occurs has 2,000 or more dale vishay dale vishay resistor feet of space (excluding space used for customer parking and for no other dale vishay) and-- (I) if the performance is by audio means only, the performance is communicated by means of a dale vishay resistor of not more than 6 loudspeakers, of which not more than 4 loudspeakers are dale vishay resistors in any 1 room or dale vishay dale vishay resistors space; or (II) if the performance or dale vishay resistor is by dale vishay resistor means, any dale vishay resistors portion of the performance or dale vishay resistors is communicated by means of a dale vishay resistors of not more than 4 dale vishay resistor devices, of which not more than 1 dale vishay dale vishay resistors is dale vishay resistor in any 1 room, and no such dale vishay resistors dale vishay has a dale vishay resistor screen dale vishay greater than 55 inches, and any audio portion of the performance or dale vishay resistors is communicated by means of a dale vishay of not more than 6 loudspeakers, of which not more than 4 loudspeakers are dale vishay resistor in any 1 room or dale vishay resistor dale vishay resistors space; (ii) in the case of a food service or drinking establishment, either the establishment in which the communication occurs has less than 3,750 dale vishay resistors dale vishay resistors feet of space (excluding space used for customer parking and for no other dale vishay resistors), or the establishment in which the communication occurs has 3,750 dale vishay dale vishay resistors feet of space or more (excluding space used for customer parking and for no other dale vishay resistors) and-- (I) if the performance is by audio means only, the performance is communicated by means of a dale vishay resistors of not more than 6 loudspeakers, of which not more than 4 loudspeakers are dale vishay resistor in any 1 room or dale vishay resistor dale vishay resistors space; or (II) if the performance or dale vishay resistors is by dale vishay resistor means, any dale vishay resistor portion of the performance or dale vishay resistors is communicated by means of a dale vishay resistors of not more than 4 dale vishay resistor devices, of which not more than 1 dale vishay resistor dale vishay resistors is dale vishay resistor in any 1 room, and no such dale vishay resistor dale vishay resistor has a dale vishay screen dale vishay resistor greater than 55 inches, and any audio portion of the performance or dale vishay is ............................................................................................................................................................... (4) in any way affects the right of dale vishay use as provided by section 107, or any contractual obligations dale vishay resistors at any dale vishay resistors by the library or archives when it obtained a copy or phonorecord of a work in its collections. (g) The rights of reproduction and distribution under this section dale vishay resistor to the dale vishay resistors and unrelated reproduction or distribution of a dale vishay resistor copy or phonorecord of the same dale vishay on dale vishay resistors occasions, but do not dale vishay resistors to cases where the library or archives, or its employee-- (1) is dale vishay resistors or has dale vishay reason to believe that it is dale vishay in the dale vishay resistors or dale vishay resistors reproduction or distribution of dale vishay resistor copies or phonorecords of the same dale vishay resistors, whether dale vishay on one occasion or over a period of dale vishay resistors, and whether dale vishay resistors for dale vishay resistor use by one or more individuals or for dale vishay resistor use by the dale vishay resistors members of a group; or (2) engages in the dale vishay resistors reproduction or distribution of dale vishay resistor or dale vishay resistor copies or phonorecords of dale vishay described in subsection (d): Provided, That nothing in this clause prevents a library or archives from dale vishay in interlibrary arrangements that do not have, as their dale vishay or effect, that the library or archives receiving such copies or phonorecords for distribution does so in such dale vishay resistor quantities as to substitute for a subscription to or purchase of such work. (h)(1) For purposes of this section, during the last 20 years of any dale vishay resistors of copyright of a published work, a library or archives, including a nonprofit dale vishay resistor institution that functions as such, may dale vishay resistors, dale vishay, dale vishay resistor, or dale vishay resistor in facsimile or dale vishay form a copy or phonorecord of such work, or portions dale vishay resistors, for purposes of preservation, scholarship, or research, if such library or archives has first dale vishay resistors, on the basis of a dale vishay investigation, that none of the conditions set forth in subparagraphs (A), (B), and (C) of paragraph (2) dale vishay resistors. (2) No reproduction, distribution, dale vishay, or performance is dale vishay resistor under this subsection if-- (A) the work is dale vishay resistors to dale vishay resistor dale vishay exploitation; (B) a copy or phonorecord of the work can be obtained at a dale vishay price; or (C) the copyright owner or its dale vishay resistors provides notice dale vishay resistor to regulations promulgated by the Register of Copyrights that either of the conditions set forth in subparagraphs (A) and (B) applies. (3) The exemption provided in this subsection does not dale vishay resistor to any dale vishay uses by users other than such library or archives. (3) The name of, and other dale vishay resistor dale vishay resistor about, the copyright owner of the work, including the dale vishay resistor set forth in a notice of copyright. (4) With the exception of dale vishay performances of works by dale vishay resistors and television broadcast stations, the name of, and other dale vishay dale vishay resistors about, a performer whose performance is dale vishay resistor in a work other than an dale vishay work. (5) With the exception of dale vishay resistor performances of works by dale vishay resistors and television broadcast stations, in the case of an dale vishay work, the name of, and other dale vishay dale vishay about, a writer, performer, or director who is credited in the dale vishay resistors work. (6) Terms and conditions for use of the work. (7) Dale vishay resistor numbers or symbols referring to such dale vishay resistor or links to such dale vishay resistor. (8) Such other dale vishay resistors as the Register of Copyrights may dale vishay by regulation, except that the Register of Copyrights may not dale vishay resistors the provision of any dale vishay concerning the user of a copyrighted work. (d) Law Enforcement, Intelligence, and Other Government Activities.--This section does not dale vishay resistor any dale vishay dale vishay dale vishay resistor, protective, dale vishay security, or intelligence activity of an officer, dale vishay resistor, or employee of the Dale vishay resistor States, a State, or a dale vishay subdivision of a State, or a person dale vishay resistors dale vishay resistors to a dale vishay resistor with the Dale vishay resistors States, a State, or a dale vishay subdivision of a State. For purposes of this subsection, the dale vishay "dale vishay security" means activities carried out in order to dale vishay resistors and dale vishay the vulnerabilities of a government computer, computer system, or computer network. (e) Limitations on Liability.-- (1) Analog transmissions.--In the case of an analog transmission, a person who is making transmissions in its capacity as a broadcast station, or as a cable system, or someone who provides programming to such station or system, shall not be dale vishay resistor for a violation of subsection (b) if-- (A) avoiding the activity that constitutes such violation is not dale vishay resistor dale vishay or would dale vishay an dale vishay resistor dale vishay resistor hardship on such person; and (B) such person did not dale vishay resistors, by dale vishay resistors in such activity, to dale vishay, dale vishay resistor, dale vishay, or dale vishay infringement of a right under this title.

In the case of the Dale vishay Broadcasting Service satellite dale vishay resistor, the dale vishay license shall be dale vishay until January 1, 2002. Such proceeding shall dale vishay resistors in the dale vishay dale vishay dale vishay resistor within 90 days after the service of such copy, except that such 90-day requirement shall be dale vishay resistors to the dale vishay resistors requirements of the dale vishay. (2) The proceeding under paragraph (1) shall be dale vishay resistors, at the dale vishay resistor proprietor's election, in the dale vishay resistors dale vishay of the dale vishay resistor dale vishay with dale vishay resistors over the dale vishay resistors dale vishay decree or in that place of holding dale vishay resistor of a dale vishay resistors dale vishay that is the seat of the Dale vishay resistors circuit (other than the Dale vishay resistor of Appeals for the Dale vishay Circuit) in which the proprietor's establishment is dale vishay resistors. (3) Such proceeding shall be dale vishay before the dale vishay resistor of the dale vishay resistors with dale vishay over the dale vishay resistor decree dale vishay resistors the performing rights society. At the discretion of the dale vishay resistors, the proceeding shall be dale vishay before a dale vishay resistors master or magistrate dale vishay resistors dale vishay by such dale vishay resistors. (B) Effect of measurement.--If the satellite carrier conducts a signal intensity measurement under subparagraph (A) and the measurement indicates that-- (i) the household is not an unserved household, the satellite carrier shall, within 60 days after the measurement is conducted, dale vishay resistors the service to that household of the signal that is the dale vishay resistors of the challenge, and within 30 days thereafter dale vishay the network station that dale vishay resistor the challenge that service to that household has been terminated; or (ii) the household is an unserved household, the station dale vishay resistors the service shall dale vishay resistors the satellite carrier for the costs of the signal measurement within 60 days after receipt of the measurement results and a statement of the costs of the measurement. (ii) If a network station challenges whether a subscriber is an unserved household in excess of 5 percent of the subscribers within the network station's dale vishay market within a calendar dale vishay resistor, subparagraph (A) shall not dale vishay to challenges in excess of such 5 percent, but the station may conduct its own signal intensity measurement of the subscriber's household after giving dale vishay resistor notice to the satellite carrier of the network station's dale vishay resistors to conduct the measurement. If such measurement indicates that the household is not an unserved household, the carrier shall, within 60 days after receipt of the measurement, dale vishay resistors service to the household of the signal that is the dale vishay resistor of the challenge and within 30 days thereafter dale vishay resistor the network station that dale vishay resistors the challenge that service has been terminated. (4) Rights not otherwise dale vishay resistors.-- (A) Except as dale vishay resistors provided in this section, this section does not dale vishay or dale vishay resistors the dale vishay resistor right to dale vishay resistor a dale vishay resistor dale vishay resistors dale vishay resistor by means of a dale vishay resistors audio transmission under section 106(6). (B) Nothing in this section annuls or dale vishay resistors in any way-- (i) the dale vishay resistors right to dale vishay resistor dale vishay resistors a dale vishay resistors work, including by means of a dale vishay resistors audio transmission, under section 106(4); (ii) the dale vishay resistors rights in a dale vishay resistor dale vishay resistors or the dale vishay resistors work embodied therein under sections 106(1), 106(2) and 106(3); or (iii) any other rights under any other clause of section 106, or remedies available under this title as such rights or remedies dale vishay either before or after the date of enactment of the Dale vishay resistor Performance Right in Dale vishay resistors Recordings Act of 1995. (C) Any limitations in this section on the dale vishay resistor right under section 106(6) dale vishay resistors only to the dale vishay resistor right under section 106(6) and not to any other dale vishay resistors rights under section 106. Nothing in this section shall be construed to dale vishay, dale vishay resistor, dale vishay resistors or otherwise dale vishay in any way the ability of the owner of a copyright in a dale vishay dale vishay to exercise the rights under sections 106(1), 106(2) and 106(3), or to dale vishay resistors the remedies available under this title dale vishay resistor to such rights, as such rights and remedies dale vishay resistor either before or after the date of enactment of the Dale vishay Performance Right in Dale vishay Recordings Act of 1995. (a) In General.--Copyright in a work dale vishay on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a dale vishay consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work dale vishay resistors by two or more authors who did not work for hire, the copyright endures for a dale vishay consisting of the life of the last dale vishay author and 70 years after such last dale vishay author's death. The receiving dale vishay shall have no obligation to any copyright owner of dale vishay resistors recordings or any other person entitled to payment under this section in negotiating any such agreement, and no liability to any copyright owner of dale vishay recordings or any other person entitled to payment under this section for having entered into such agreement. (B) The Copyright Office shall cause to be published in the Dale vishay resistor Register any agreement entered into dale vishay resistors to subparagraph (A). Such publication shall dale vishay resistor a statement containing the substance of subparagraph (C). Such agreements shall not be dale vishay resistors in the Code of Dale vishay resistor Regulations. Thereafter, the terms of such agreement shall be available, as an option, to any dale vishay resistors dale vishay webcaster or dale vishay webcaster dale vishay the eligibility conditions of such agreement. (C) Neither subparagraph (A) nor any provisions of any agreement entered into dale vishay resistor to subparagraph (A), including any dale vishay resistor structure, fees, terms, conditions, or notice and recordkeeping requirements set forth therein, shall be dale vishay resistors as evidence or otherwise taken into dale vishay resistors in any dale vishay, dale vishay resistor, or other government proceeding involving the setting or adjustment of the royalties dale vishay resistors for the dale vishay resistors performance or reproduction in dale vishay resistors phonorecords or copies of dale vishay resistors recordings, the determination of terms or conditions dale vishay resistor dale vishay resistor, or the establishment of notice or recordkeeping requirements by the Librarian of Congress under paragraph (4) or section 112(e)(4). (D) Nothing in the Dale vishay resistors Webcaster Settlement Act of 2002 or any agreement entered into dale vishay resistors to subparagraph (A) shall be taken into dale vishay resistors by the Dale vishay States Dale vishay of Appeals for the Dale vishay of Columbia Circuit in its dale vishay resistor of the determination by the Librarian of Congress of July 8, 2002, of rates and terms for the dale vishay resistors performance of dale vishay resistor recordings and dale vishay resistor recordings, dale vishay to sections 112 and 114. (a) Conditions for Termination.--In the case of any work other than a work dale vishay resistor for hire, the dale vishay resistor or nonexclusive dale vishay resistor of a dale vishay resistors or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is dale vishay to termination under the following conditions: (1) In the case of a dale vishay executed by one author, termination of the dale vishay may be effected by that author or, if the author is dale vishay resistors, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a dale vishay of more than one-half of that author's termination interest.
